This is a promotional prize draw which is operated by Luke Roper Ltd of Luke Roper Ltd, PO Box 403, Bicester OX26 9HA (“Luke”) and all eligible entrants are offered the chance to win one of ten “Tail G” electric scooters (“Scooter”) customised with LUKE branding, in accordance with and subject to these Terms. Luke can be contacted in relation to this prize draw at info@luke1977.com.
By entering this prize draw, all entrants to this prize draw confirm that they have read and understood these Terms and agree to be bound by them, and confirm that they are entitled and eligible to enter into this prize draw and comply with these Terms.
The prizes are ten Scooters available to be won by entrants which have been customised with Luke branding, and a full specification of the Scooters to be won can be found here. The Scooters are not manufactured, nor are they intended for, road use.
All Scooters to be won in this prize draw are provided strictly subject to these Terms, including the exclusions and limitations of liability set out below.
Multiple entries are permitted. Entries to this prize draw may only be made using the official Luke entry post-card provided to consumers upon purchase of a Luke product from the Luke Summer/ Autumn 2011 product collections, and entries in any other form will be invalid. The official Luke entry post-card must be mailed (postage paid) to Luke at the address above by the Closing Date.
Entrants are solely responsible for the accuracy and completeness of the information provided on the official Luke entry post-card when entering this prize draw. Inaccuracies or errors in information provided or provision of incomplete information by entrants may invalidate an entry application and Luke reserves to right to refuse any entry in such circumstances without liability. No responsibility is accepted by Luke for honestly lost or misplaced entries.
Notwithstanding the requirement for eligible entrants to purchase a Luke product from the Luke Summer/ Autumn 2011 product collections as above in order to enter, this prize draw is free to enter to all eligible entrants since all such Luke products are sold at fair retail price to such consumers without any inflation of product price and there is no additional cost or fee required from eligible entrants to enter this prize draw.
This prize draw is now open for entries and will remain open until the final closing date for entries of 30th September 2011 (“Closing Date”). Luke has sole discretion as to whether or not to accept entries post-marked on or before the Closing Date actually received after that date. Otherwise, entries received after the Closing Date will be invalid and will not be included in this prize draw.
In the event of any change to the Closing Date a notification of the change will be posted on the Luke website at www.luke1977.com and e-mailed to all current entrants in good time before the change.
Entrants must comply with the following eligibility requirements and Luke reserves the right to refuse entry to or withhold awarding of a Scooter to entrants who do not comply.
This prize draw is not open to employees of Luke or Luke’s directors or shareholders, or any supplier, service provider or other person involved with or connected with Luke or the organisation, administration or operation of this prize draw, or such persons’ direct family relatives. Luke reserves the right to refuse any entry to this prize draw if in Luke’s reasonable opinion such entrant is connected in any of the foregoing ways to Luke or this prize draw, and any such decision by Luke to refuse entry on this basis will be final and no appeal will be available or correspondence will be entered into in relation to such decision.
Subject to the above, this prize draw is otherwise open to any private individual aged 18 years or over resident in the United Kingdom mainland, Northern Ireland, Isle of Man and the Channel Islands who makes one of more purchases of Luke product(s) from the Luke Summer/ Autumn 2011 product collections sold with an official Luke entry post-card for entry to this prize draw.
Following the Closing Date, all valid entries will be collected at the offices of Luke and the prize draw will be held on 10th October 2011 or in the event of any circumstances outside Luke’s control which make it impossible to hold the prize draw on that day as soon as reasonably practicable thereafter.
The prize draw will be conducted by an independent judge who will draw entry cards at random from all valid and eligible entries, and the ten winners of this prize draw will be the first ten valid and eligible entries drawn by the independent judge. In the event of any question regarding the conduct of the prize draw on the day, the independent judge’s decision will be final and no appeal will be available nor will any correspondence be entered into in relation to any such decision of the independent judge.
Luke will use all reasonable efforts to notify winning entrants that they have won one of the Scooters by no later than 1 November 2011. In the event that for reasons outside of Luke’s reasonable control Luke is unable to notify winners by that date, Luke will notify winning entrants that they have won one of the Scooters as soon as reasonably practicable thereafter. Luke may require proof of age and/ or proof of identity on delivery of Scooters to winning entrants.
All notifications will be by e-mail to the e-mail address provided in the relevant winning entrant’s entry and will include full details as to how winners are to contact Luke in order to claim and arrange delivery of the Scooter. Follow-up telephone calls to the telephone number provided on the relevant winning entrant’s entry may also be made for this purpose.
Subject to the remaining provisions of these Terms, Luke will use all reasonable efforts to deliver all Scooters claimed by winning entrants to this prize draw as soon as reasonably practicable after the relevant winning entrant claims it and in any event by no later than 15th December 2011. In the event that Luke is unable to deliver Scooters to any winning entrant by that date due to circumstances beyond Luke’s reasonable control, Luke will deliver the Scooter to the relevant winning entrant as soon as reasonably practicable thereafter.
Subject to the following, the cost of delivery of the Scooters to winning entrants will be met by Luke and risk and title in the Scooters will pass from Luke to the winning entrants on delivery. In the event of delivery failure through no fault of Luke, Luke will use reasonable endeavours to re-deliver but in the event that repeated attempts at delivery are required before delivery can be made, the costs of such re-delivery efforts may be charged to the relevant winning entrant.
Winning entrants must make contact with Luke as above in order to claim and arrange delivery of their Scooter, otherwise the win may be cancelled and the relevant Scooter reallocated to another entrant in accordance with the following Terms. In the event that notified winning entrants fail to make contact with Luke to claim the Scooter they have won in this prize draw or otherwise fail to communicate sufficiently with Luke by 15th December 2011 to allow delivery of the Scooter to the winning entrant, Luke will make all reasonable efforts to contact the relevant winning entrant and to deliver the Scooter to the relevant winning entrant.
In circumstances where a winning entrant cannot be contacted or located and/ or does not claim their Scooter or otherwise sufficiently communicate with Luke with regard to delivery of the Scooter won by that entrant by 15th June 2011, Luke reserves the right thereafter to reallocate that Scooter as a prize to entries drawn during the prize draw after the tenth winning entrant in order of the draw, and for this purpose during the prize draw the independent judge will draw additional reserve entrants after the first ten winning entrants. In these circumstances, after this six month deadline has passed Luke may notify in the same manner of notification prescribed above the next reserve entrant that they have won the relevant Scooter by default owing to an unclaimed prize being reallocated and the relevant original winning entrant’s claim to the relevant Scooter will expire immediately on Luke sending of such notification to the reserve entrant who will then become a winning entrant.
By entering this prize draw, all entrants hereby undertake to participate in all reasonable publicity activities relating to winners of the prize draw which Luke may reasonably require and which may include, without limitation, being interviewed by Luke or its representative in relation to Luke products and the prize draw, participating in a presentation ceremony on delivery of the Scooter, permitting Luke or its representative to film the same and use such footage for promotional purposes, and posing for publicity photographs relating to the win. All entrants permit Luke to edit and modify and to use publicly all such materials at its discretion.
Following notification of winners in accordance with these Terms, Luke may list the names of all winners and their broad geographic location (city, town or county) on the Luke website at www.Luke1977.com, and all entrants of this prize draw hereby consent to the use and publication by Luke of their name and broad geographical location, as well as the publicity photographs, films and other materials referred to above. Under no circumstances will Luke release any other personal data, such as e-mail address, telephone number, postal address etc. to the public without the relevant entrant’s express consent. Luke takes the protection of personal data and privacy seriously and will at all times comply with the Data Protection Act 1998 and Luke’s general privacy policy will also apply.
Unless entrants opt out by ticking the relevant box on the entry postcard, by entering this prize draw, entrants permit Luke to use his or her contact details for notifying future prize draws, competitions events or offers, subject that entrants may opt out at any later time by notifying Luke.
All entrants to this prize draw hereby consider the following to be a fair and reasonable allocation of risk and liability, and understand and accept that Scooters won in this prize draw are not manufactured by Luke but by a third party manufacturer.
Luke will provide and deliver Scooters to winning entrants on an “as is” basis and makes no claim, warranty or guarantee whatsoever in relation to the Scooters. Winning entrants will take delivery of the Scooters and use the Scooters entirely at their own risk and Luke will not be responsible or liable in any for any use made by winning entrants of the Scooters for which the winning entrants will be solely responsible.
In the event that any of the Scooters contain manufacturing faults or errors, winning entrants’ sole recourse is against the third party manufacturer and any manufacturing warranty (if any) will be passed to winning entrants on delivery. Luke excludes any and all liability for death, injury or property caused by the Scooters or the use made of them which may either be the liability of the manufacture in the case of manufacturing faults or errors, or the user of the Scooter in the case of use, misuse or modification of the Scooter in question. Luke will not be responsible for the acts or omissions of any third parties
Winning entrants will be liable for any taxes or costs that might be imposed on the Scooters by the authorities or third parties. For the avoidance of doubt, the Scooters exclude road tax, first registration fees and insurance for which the winning entrants will be solely liable in the event that the winning entrants, at their sole discretion and risk, decide to make the Scooters road legal.
Luke reserves the right to modify or cancel this prize draw if reasonably necessary. In such a case, no indemnity or compensation will be given to the entrants involved nor will Luke be liable or responsible to entrants for the same.
The decision of Luke will be final and binding in all matters relating to this prize draw and no correspondence will be entered into regarding such decisions.
Scooters cannot be exchanged for and are non-transferable with for other prizes, and Scooters cannot be exchanged for cash.
This prize draw will be governed by English law within the exclusive jurisdiction of the English Courts.
